Harvey Weinstein Found Guilty Of Rape And Sexual Assault Case

The 70-year-old movie producer, who was previously among the most powerful in the industry, became the face of the #MeToo movement after many women accused him of sexual assault.

What is the final decision?

Four women accused Weinstein of sexual misbehaviour between 2004 and 2013 at the Los Angeles trial.

Weinstein was found guilty by a jury of rape, forceful oral copulation, and sexual penetration by a foreign object by one victim. Harvey Weinstein.

He was cleared of all allegations against a second lady. The jury could not reach a judgement on the other two accusations. Harvey Weinstein

Jennifer Siebel Newsom, California Governor Gavin Newsom’s wife, was one of Weinstein’s accusers in this trial.

A mistrial was declared for the counts on which the jury was unable to reach a verdict.Harvey Weinstein

How has the judgement been received?

In a statement issued shortly after the judgement, the former model and actress identified as Jane Doe 1 in the trial said, “Harvey Weinstein irrevocably shattered a part of me that night in 2013, and I will never get it back.” Harvey Weinstein

Her statement said, “The criminal trial was horrible, and Weinstein’s lawyers tortured me on the witness stand, but I knew I had to persevere, and I did. I hope Weinstein never has to leave a jail cell in his life.”

Siebel Newsom stated in a statement, “Weinstein’s attorneys utilised sexism, misogyny, and bullying techniques to intimidate, belittle, and ridicule us survivors throughout the trial. The trial was a sharp reminder that we as a society have work to do.”

What kind of punishment will Weinstein face?

Weinstein may spend 18 to 24 years in jail if convicted.

On Tuesday, the attorneys will argue about aggravating elements that might alter the length of the sentence.

He is already serving a 23-year term for sexual misbehaviour after being convicted in New York.

Weinstein insisted that all of his sexual interactions were consensual and pleaded not guilty. Because there was no forensic evidence or eyewitness description of the years-old claims, the case was based on the women’s personal statements and believability.

The women freely had sex with Weinstein, according to defence counsel, because they felt he would benefit their careers. They also claimed that several of the accused, including Newsom, had maintained contact with him over the years, which made little sense if he had assaulted them.

Reversing a past conviction

Weinstein has requested to have his criminal conviction in New York reversed.

In the UK, authorities have also charged him with indecent assault coming from an incident in 1996 in London.

Over 90 women have come forward to accuse Weinstein of inappropriate and even illegal behaviour.

“She Said,” a film on the 2017 New York Times investigation into Weinstein’s charges, was just released in cinemas.

Jurors were instructed not to watch it.

The Los Angeles jury’s decision was Weinstein’s second sex offence conviction. He was convicted guilty of sexual assault and rape nearly three years ago in New York. Given that New York’s highest court has consented to review Weinstein’s conviction there, it functioned as a backup for putting him in prison.

Because of the convoluted mechanics of the conviction and the state’s sentencing regulations, Weinstein might face 18 to 24 years in jail in California, rather than the maximum of life in prison. He would serve that time after finishing his sentence in New York, where he still has 21 years to go if his appeal is successful.
